These Terms & Conditions apply to all purchases made through the True Timepieces online store. By placing an order with True Timepieces, you agree to these Terms & Conditions.

2. Applicability

These Terms & Conditions apply to all offers, orders and agreements between True Timepieces and its customers.

By placing an order through our website, you confirm that you have read and accepted these Terms & Conditions.

Nothing in these Terms & Conditions is intended to limit or exclude any mandatory rights that consumers have under applicable law.

3. Products and Product Information

True Timepieces primarily sells vintage and pre-owned watches.

We make every reasonable effort to ensure that product descriptions, photographs and other information on our website are accurate and up to date.

Because vintage and pre-owned watches have a history and may be several decades old, individual watches may show signs of age or previous use. These may include, depending on the individual watch:

• scratches or small marks;

• patina;

• discoloration;

• fading;

• signs of previous servicing;

• replacement components;

• wear to the bracelet or strap;

• other characteristics associated with age and previous ownership.

Where reasonably possible, relevant condition details are described in the product listing and/or shown in the photographs.

The customer is responsible for reviewing the product description and photographs before placing an order.

4. Vintage and Pre-Owned Condition

A vintage or pre-owned watch should not be expected to have the same condition as a new watch.

Normal signs of age, wear and patina that are clearly described or visible in the product listing are considered part of the condition of the watch.

However, this does not affect any statutory rights the customer may have if a product does not conform to the agreement or does not meet the reasonable expectations applicable under law.

5. Watch Accuracy and Mechanical Performance

Mechanical and vintage watches may naturally have variations in timekeeping depending on their age, movement, servicing history, position and usage.

Unless explicitly stated otherwise in the product listing, a statement that a watch is functioning or running does not constitute a guarantee of a specific level of accuracy or power reserve.

Where we have information regarding the condition, servicing history or performance of a watch, we will provide this information where reasonably possible.

6. Prices

All prices displayed on our website are stated in the applicable currency and include VAT where legally required.

Any additional costs, such as shipping costs, will be clearly displayed before the customer completes the order.

True Timepieces reserves the right to correct obvious pricing or information errors before an order is accepted.

If an obvious error occurs, such as an incorrect price caused by a technical or input error, True Timepieces may contact the customer before fulfilling the order.

7. Orders and Contract Formation

When you place an order through our website, you submit an offer to purchase the selected product.

After placing an order, you will receive an order confirmation by email.

A purchase agreement is concluded when True Timepieces accepts the order, subject to applicable consumer law.

If we are unable to fulfil an order, we will inform you as soon as reasonably possible and refund any payment already made for that order.

8. Payment

Payment must be completed using one of the payment methods made available during checkout.

An order will generally only be shipped once payment has been successfully received, unless otherwise agreed.

9. Shipping and Delivery

We will ship orders to the delivery address provided by the customer during checkout.

Estimated delivery times are provided for information purposes and may vary depending on the destination, carrier and circumstances beyond our reasonable control.

We are responsible for ensuring that the product is delivered in accordance with applicable consumer law.

The customer is responsible for providing a correct and complete delivery address.

If an incorrect address is provided by the customer and this causes additional shipping or delivery costs, the customer may be responsible for those additional costs where permitted by law.

10. Risk During Shipping

For consumer purchases, the risk of loss or damage generally remains with True Timepieces until the product has been delivered to the consumer or a third party designated by the consumer, unless applicable law provides otherwise.

We will take reasonable care to package watches securely for transportation.

11. Right of Withdrawal

Consumers purchasing online have a statutory 14-day right of withdrawal.

The customer may withdraw from the purchase without providing a reason within 14 days after receiving the watch.

The statutory right of withdrawal also applies to vintage, pre-owned and discounted watches, unless a specific legal exception applies.

12. Return Shipping Costs

When exercising the statutory right of withdrawal, the customer is responsible for the direct cost of returning the watch, provided that this has been communicated to the customer before purchase.

True Timepieces does not provide a free return shipping label for standard returns.

Because our watches may have significant value, we strongly recommend using a tracked and insured shipping service.

This does not apply where the watch is defective, incorrectly supplied or otherwise does not conform to the agreement and applicable law requires True Timepieces to bear the return costs.

13. Inspection and Reduction in Value

The customer has the right to inspect and assess the watch during the withdrawal period as reasonably necessary to establish its nature, characteristics and functionality.

The customer is responsible for any reduction in value caused by handling or use beyond what is necessary for such inspection.

This may include, for example:

• wearing the watch for an extended period;

• causing new scratches, dents or other damage;

• damaging the case, crystal, crown, bracelet or strap;

• exposing the watch to water when this is not necessary for inspection;

• modifying the watch;

• replacing or removing components;

• losing or damaging accessories or documentation.

• Removing any stickers, plastic or else. 

Where legally permitted, True Timepieces may deduct the demonstrable reduction in value from the amount refunded.

14. Statutory Warranty and Conformity

Nothing in these Terms & Conditions limits the customer's statutory rights regarding defective or non-conforming products.

If a watch does not conform to the agreement or does not meet the reasonable expectations applicable under law, the customer may have rights to a repair, replacement, price reduction or refund, depending on the circumstances and applicable law.

Any issues should be reported to True Timepieces so that we can assess the appropriate solution.

The fact that a watch is vintage or pre-owned does not remove statutory consumer rights.

15. Commercial Warranty

Unless explicitly stated otherwise on the relevant product page or in a separate warranty document, True Timepieces does not provide an additional commercial warranty beyond the statutory rights applicable to the purchase.

Where a specific commercial warranty is offered for a particular watch, its terms will be clearly communicated before purchase.

16. Water Resistance

Unless explicitly stated otherwise for a specific watch, vintage and pre-owned watches should not be assumed to be water resistant.

Water resistance can deteriorate over time due to age, seals, servicing history and previous use.

Customers should therefore avoid exposing vintage and pre-owned watches to water unless the current water resistance of the specific watch has been professionally verified and this has been explicitly stated by True Timepieces.

Any damage caused by water exposure where water resistance was not explicitly guaranteed is not automatically considered a defect.

17. Servicing and Repairs

Vintage watches may contain original, replacement or previously serviced components.

Unless explicitly stated otherwise, True Timepieces does not guarantee that every component of a vintage watch is original to the year of manufacture.

If a servicing history is known, this information will be disclosed where reasonably possible.

Customers should not modify, open or have a watch repaired by a third party if they wish to make a claim regarding a suspected defect. Please contact True Timepieces first so that the issue can be assessed.

We will make reasonable efforts to respond to complaints as soon as possible and work with the customer to find an appropriate solution.

19. Intellectual Property

All photographs, product descriptions, logos, graphics, text and other content published by True Timepieces are protected by applicable intellectual property laws.

Unless expressly permitted, this content may not be copied, reproduced, distributed, modified or used commercially without prior written permission from True Timepieces.

20. Website Information

We make reasonable efforts to ensure that information on the website is accurate.

However, occasional typographical, technical or other errors may occur.

True Timepieces reserves the right to correct errors and update website information where necessary.

Such corrections do not affect orders that have already been concluded, except where applicable law permits otherwise.

21. Limitation of Liability

To the extent permitted by applicable law, True Timepieces is not liable for indirect or consequential losses that are not reasonably foreseeable at the time the agreement was concluded.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

Nothing in these Terms & Conditions limits the statutory rights of consumers.

22. Force Majeure

True Timepieces is not responsible for delays or failures caused by circumstances beyond our reasonable control, such as natural disasters, war, strikes, major transport disruptions, government measures, technical failures or other circumstances that could not reasonably have been prevented.

Where such circumstances occur, we will make reasonable efforts to inform affected customers and fulfil the order as soon as reasonably possible.

23. Changes to These Terms & Conditions

True Timepieces may update these Terms & Conditions from time to time.

The version applicable to an order is the version that was made available to the customer before or at the time the purchase agreement was concluded.

Changes will not retroactively alter the rights and obligations of an existing order unless required or permitted by law.

24. Applicable Law

These Terms & Conditions and agreements between True Timepieces and consumers are governed by Dutch law, to the extent permitted by applicable law.

Consumers who reside in another country within the European Union retain any mandatory rights and protections granted to them under the applicable law that cannot legally be excluded by agreement.

25. Final Provision

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in effect.

The invalid or unenforceable provision will be interpreted or replaced to the extent necessary to comply with applicable law while preserving its intended purpose as far as legally possible.
